These Service Pro Terms of Service (“Pro Terms”) govern your access to and use of the Jobzen Platform operated by Homepro Network LLC d/b/a Jobzen (“Jobzen,” “we,” “us,” or “our”). By registering as a Service Professional (“Pro,” “you,” or “your”) and accessing or using the Jobzen website, mobile app, or related services (collectively, the “Platform”), you agree to these Pro Terms. If you do not agree, do not use the Platform.

Nature of the Platform
Jobzen provides a digital marketplace connecting independent service professionals with customers seeking household services (“Services”).
Jobzen is not:
A general contractor
A construction manager
An employer
A joint venture partner
A franchisor
You operate as an independent business and are solely responsible for the Services you provide.

Independent Contractor Status
You acknowledge and agree that:
You are an independent contractor.
You are not an employee, agent, or representative of Jobzen.
You control the manner, means, and methods of performing Services.
You supply your own tools, materials, equipment, and transportation.
You are responsible for your own taxes, licensing, permits, and compliance.
Nothing in these Pro Terms creates an employment relationship.

You are not an employee, agent, or representative of Jobzen.

Pro Eligibility and Verification
To access and remain active on the Platform, you must:
Provide accurate identity and contact information.
Complete background and identity verification (where required).
Maintain any required business licenses.
Maintain insurance or enroll in Jobzen’s coverage program if applicable.
Comply with all applicable federal, state, and local laws.
Jobzen reserves the right to suspend or deactivate your account at its sole discretion for safety, compliance, or quality concerns.

Service Standards
You agree to:
Perform Services professionally and competently.
Communicate clearly and respectfully with Customers.
Arrive on time and complete Services as agreed.
Follow all safety practices and legal requirements.
Use lawful, non-hazardous materials and practices.
You are solely responsible for workmanship, outcomes, and conduct.

Booking, Payments, and Platform Fees
All scheduling, communication, and payment must occur within the Platform.
When a Customer accepts a completed job:
Payment is released to you, minus Jobzen’s platform fee.
You authorize Jobzen to process payments on your behalf.
You agree not to request off-platform payment.
You understand and agree that:
Jobzen may deduct platform fees and applicable processing fees.
Platform fees may change upon notice.
You are responsible for all applicable taxes on earnings.
All scheduling, communication, and payment must occur within the Platform.
When a Customer accepts a completed job:
Payment is released to you, minus Jobzen’s platform fee.

Completion and Disputes
You must:
Allow customers reasonable opportunity to inspect completed work.
Address reasonable concerns prior to departure.
Participate in good-faith resolution if a dispute is filed within the allowed timeframe.
Jobzen may facilitate dispute resolution but does not guarantee payment in cases of proven fraud, material misrepresentation, or policy violation.
You must:

Non-Circumvention
You agree not to solicit, accept, or perform off-platform work for any Customer introduced through Jobzen for a period of twenty-four (24) months following introduction.
Violation may result in:
Immediate deactivation
Forfeiture of pending earnings
Liquidated damages equal to the estimated value of the circumvented work plus administrative costs

Insurance and Liability
You are solely responsible if you do not elect Jobzen Protect Coverage:
Maintaining required insurance
Any damages or losses arising from your Services
Compliance with all applicable laws and safety standards
If participating in Jobzen’s insurance program, coverage is subject to its terms and conditions and does not replace your primary liability coverage.

Limitation of Liability
To the fullest extent permitted by law:
Jobzen is not liable for your acts, omissions, or negligence.
Jobzen does not guarantee volume of jobs or earnings.
Jobzen makes no representations regarding income potential.

If a Customer files a chargeback:
Jobzen may provide documentation to payment processors.
If the chargeback is upheld due to your misconduct or policy violation, the disputed amount may be deducted from future earnings.
Fraudulent behavior may result in permanent removal and legal action.

Modifications
Jobzen may update these Pro Terms at any time. Continued use of the Platform constitutes acceptance of modifications.

Governing Law and Arbitration
Any dispute arising out of or relating to these Pro Terms or the Platform shall be resolved by final and binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.
You waive the right to trial by jury and agree that claims will be brought individually, not as a class action.

Entire Agreement
These Pro Terms constitute the entire agreement between you and Jobzen regarding your use of the Platform and supersede all prior agreements or understandings.
